PENN YAN — Police arrested Robert B. Foley, 67, of Rochester for DWI, open container and leaving the scene of a property damage accident following a hit-and-run collision at a village business.
A witness provided police with Foley’s vehicle description and direction of travel after the collision.
Police located Foley and his vehicle in the parking lot of another village business.
Officers observed Foley showing several signs of intoxication and found him in possession of an open container of alcohol in the vehicle.
Foley failed a series of standardized field sobriety tests.
Police arrested Foley and transported him to the Yates County Jail for a chemical breath test, which he refused.
Foley was later transported to the Penn Yan Police Department for processing and released on tickets to appear in Penn Yan Village Court.
